On Monday, a judge rejected Philadelphia District Attorney Larry Krasner’s request to stop Elon Musk’s America PAC from distributing $1 million in giveaways to voters in swing states.
Starting on October 19, Musk’s pro-Trump PAC began giving away $1 million each day to voters who signed a petition supporting the First and Second Amendments. The final two recipients are expected to be revealed on Monday night in Arizona and Tuesday in Michigan, according to the Associated Press.
The giveaways faced opposition from Democrats, with Krasner calling it a “scam” designed to influence national elections. He also argued that the giveaways constituted an illegal lottery violating state law. In response, Musk’s attorney Chris Gober argued in court that the winners were not chosen randomly.
“We know exactly who will be named as the $1 million recipient today and tomorrow,” Gober stated, explaining that the recipients were selected based on their ability to represent the PAC effectively. Chris Young, the PAC’s director, testified that winners are carefully vetted to ensure their values align with those of America PAC.
Common Pleas Court Judge Angelo Foglietta dismissed Krasner’s claim that the giveaways constituted an illegal lottery, as reported by CNN.
Last month, Musk revealed the $1 million giveaways at a town hall event in Harrisburg, Pennsylvania, telling the audience, “I have a surprise for you: we’re going to award a million dollars each day to people who have signed the petition, starting now and continuing until the election.”
During his testimony, Young stated that “randomly” was not the term he would have used to describe the giveaways, according to the AP. Musk’s legal team argued that the petition represents “core political speech” as it supports the Constitution. They also contended that Krasner’s effort to halt the giveaways was irrelevant, as no further winners would be selected from Pennsylvania.
