In court filings, Berry argues that Martinez’s involvement is not in the child’s best interests. She is seeking either full custody or, alternatively, the authority to make final decisions regarding Maceo’s education, health, and therapy needs. Berry acknowledges her own imperfections but emphasizes her commitment to prioritizing her son’s welfare. The legal documents highlight ongoing educational challenges and Berry’s efforts to secure appropriate tutoring, assessments, and a suitable environment for Maceo.
The filing alleges that Olivier Martinez’s actions and lack of cooperation regarding Maceo’s psychological and educational needs have negatively impacted the child’s health and well-being. It claims that Martinez’s refusal to allow early interventions has led to Maceo falling further behind in school, exacerbated his acting-out behaviors, and damaged the relationship between Maceo and Halle Berry. The document also describes Martinez as being resistant and uncooperative, stating that his focus on soccer activities over Maceo’s educational and psychological needs has worsened the child’s challenges and hindered his academic progress.
Berry asserted that Maceo tends to “act out” towards her after spending extended periods in his father’s custody. She also noted that Martinez has claimed Maceo is “old enough to make his own decisions.”
Berry and Martinez concluded their divorce last year after a protracted legal dispute. As part of the settlement, Berry was required to pay her ex-husband nearly $8,000 a month in child support, plus 4.3% of any income she earns over $2 million. In addition to this, Berry covers Maceo’s private school tuition, extracurricular activities, and health care expenses.
Berry previously endured a contentious custody battle with her former partner, Gabriel Aubry, regarding their daughter. In 2012, their conflict escalated into a physical altercation, resulting in Aubry’s arrest. The incident arose when Aubry attempted to prevent Berry from relocating their daughter to France to live with Martinez, whom she was dating at the time.
